The Position and Role of the Data Protection Officer in the Risk-Based Framework of the Artificial Intelligence Regulation

Abstract

With the Artificial Intelligence Act (AIA), the European Union has reached another milestone in the field of technology regulation. As with the General Data Protection Regulation (GDPR), a risk-based approach is at the heart of the legislation, but this is not the only reason to compare the two regulatory regimes. The protection of personal data is also emphasised in the AIA, but different mechanisms from the GDPR regulation have been defined.

The Data Protection Officer (DPO) is one of the cornerstones of GDPR compliance, one of the legal safeguards for the protection of personal data, a role not envisaged in the AIA, but which is significantly affected by the provisions of the AIA. The present paper aims to describe the tasks and role of the DPO in the context of the AIA.
